# Why Broker Liability Is Becoming a *Chain-of-Custody Execution Problem*

Freight risk increasingly depends on whether an organization can connect identities, decisions, handoffs, exceptions, and proof into one reviewable record.

The custody chain

**Selected** The carrier, driver, equipment, and pickup credentials connect to the load.

**Verified** Checks and approvals continue as execution unfolds.

**Transferred** Handoffs, changes, documents, and exceptions become visible events.

**Proven** The outcome is supported by a complete, auditable history.

Freight brokers operate in an environment built on speed, coordination, and trust. Every load may involve a shipper, broker, carrier, driver, pickup location, receiver, and several people approving decisions along the way.

When everything goes according to plan, the process can feel routine. When something goes wrong, the quality of the custody chain becomes critical.

A claim, stolen load, identity issue, disputed instruction, service failure, or delivery exception can force teams to answer difficult questions:

Who was involved? What was verified? When did each event occur? Were there exceptions? What evidence supports the outcome?

The issue is not simply whether the broker followed a process. The issue is whether the organization can demonstrate that process with a complete chain-of-custody record.

That is why broker liability is increasingly becoming a custody-chain problem.

## Most brokers already have the information

Freight organizations generate significant data during every shipment. They may have carrier onboarding records, insurance documents, rate confirmations, bills of lading, emails, text messages, call notes, tracking updates, pickup documentation, and proof of delivery.

The challenge is rarely a total absence of information. The challenge is that the information is scattered across systems, inboxes, devices, and individual employees.

One person may verify the carrier. Another may approve a change by email. A driver may send a document by text. A pickup discrepancy may be discussed over the phone. The delivery record may arrive later in a separate inbox.

Each action may have been reasonable. The problem appears when the organization has to reconstruct the shipment after the fact.

Fragmented evidence asks, “What do we think happened?”

A custody-chain record asks, “What does the record show?”

## Freight authentication cannot stop at onboarding

Freight authentication is often treated as a carrier-selection activity. A broker verifies operating authority, insurance, registration, and contact information before assigning the load.

Those checks are important, but conditions can change after the load is tendered. A different driver may arrive. A phone number may no longer match. A pickup location may receive revised instructions. A delivery address may change. A new contact may request access to the freight. A document or payment instruction may be replaced.

Some changes are legitimate. Others may indicate fraud, impersonation, unauthorized rebrokering, or a breakdown in communication.

The chain-of-custody record should capture what happened when the shipment changed hands or departed from the plan. It should show who requested or participated in the event, who reviewed it, what checks or exceptions were recorded, and who approved the decision.

Freight authentication is strongest when it continues throughout the full execution journey.

## Policies describe intent. A custody chain shows action.

Most brokers have procedures for carrier selection, fraud prevention, shipment monitoring, exception management, and document retention. Those policies matter.

But a policy describes what the organization intends to do. A chain-of-custody record shows what the organization actually did on a specific load.

A strong response is not simply, “This is our normal procedure.”

A stronger response is: “Here is the time-stamped custody record showing what decision was made, who made it, what changed, and what evidence supported the outcome.”

A chain-of-custody record does not eliminate liability. It reduces uncertainty and provides a clearer, more defensible account of the organization’s actions.

A real-time custody workflow can also alert teams when execution deviates from the plan. That empowers teams to act while circumstances are still changing.

## Visibility is not the same as execution proof

Freight visibility answers an essential question:

Where is the shipment?

Execution proof answers different questions: Who handled it? What was verified? What changed? Who approved the change? What evidence supports the outcome?

A tracking location cannot show whether the correct driver received the freight. An estimated arrival time cannot prove who authorized a redirection. A delivered notification cannot establish whether the expected handoffs occurred.

Visibility remains important, but it does not replace a connected operational record that drives accountability.

## What should a stronger custody record include?

A useful chain-of-custody record is not simply a larger document archive. It is a connected record of the identities, decisions, handoffs, changes, documents, and exceptions associated with the shipment’s execution workflow.

At minimum, the record should answer five questions:

## A better custody chain supports better decisions

A real-time custody record is valuable long before a dispute occurs. It can help teams:

- Mitigate disruptions in real time
- Investigate exceptions faster
- Give customers self-service access to relevant records
- Identify recurring process gaps, fraud patterns, or operational failures
- Support transportation and supply-chain planning
- Support cargo-claim reviews
- Reduce dependence on tribal knowledge
- Improve accountability across handoffs

The record can also help leadership understand whether required procedures are followed consistently. If the same exception repeatedly creates confusion, the issue may indicate a weakness in the workflow rather than an isolated mistake.
